Agreement to Terms

By accessing our website or renting a golf cart from Wild Ranch Cart Rentals, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.

Rental Eligibility

To rent a golf cart from Wild Ranch Cart Rentals, you must:

• Be at least 18 years of age
• Possess a valid driver's license
• Provide accurate identification and contact information
• Have a valid payment method
• Agree to operate the cart in accordance with all applicable laws and event rules

Rental Period and Rates

• Rental periods are based on weekly rates aligned with event dates
• Carts must be picked up and returned at the designated times and locations
• Late returns may incur additional charges
• Rates are subject to applicable taxes and fees as displayed at checkout

Payment Terms

• A deposit is required at the time of booking
• The remaining balance is due before the rental period begins
• All payments are processed securely through Stripe
• A security deposit or hold may be required and will be released upon satisfactory return of the cart

Cancellation and Refunds

• Cancellations made 7 or more days before the rental start date: Full refund
• Cancellations made 3-6 days before: 50% refund
• Cancellations made less than 3 days before: No refund
• No-shows are not eligible for refunds
• We reserve the right to cancel rentals due to weather or safety concerns, with a full refund provided

Renter Responsibilities

As a renter, you agree to:

• Operate the golf cart safely and responsibly
• Follow all event venue rules and traffic regulations
• Not allow unlicensed or unauthorized persons to operate the cart
• Keep the cart on designated paths and approved areas
• Not operate the cart under the influence of alcohol or drugs
• Report any damage or mechanical issues immediately
• Return the cart in the same condition as received (normal wear excepted)
• Charge the cart as instructed (for electric models)

Prohibited Uses

The following activities are strictly prohibited:

• Operating the cart on public roads (unless specifically permitted)
• Racing, reckless driving, or stunt driving
• Overloading the cart beyond its rated capacity
• Towing or pushing other vehicles or objects
• Transporting hazardous materials
• Subletting or re-renting the cart
• Any illegal activity

Damage and Liability

• You are responsible for any damage to the cart during your rental period
• Damage costs will be assessed and charged to your payment method on file
• You are liable for any injuries or property damage caused by your operation of the cart
• Wild Ranch Cart Rentals is not responsible for personal property left in or on the cart
• We recommend reviewing your personal insurance coverage before renting

Limitation of Liability

To the maximum extent permitted by law, Wild Ranch Cart Rentals shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount paid for your rental.

Indemnification

You agree to indemnify, defend, and hold harmless Wild Ranch Cart Rentals, its owners, employees, and agents from any claims, damages, losses, or expenses arising from your use of our rental equipment or violation of these terms.

Modifications to Service

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time. We may also update these Terms of Service, and continued use of our services constitutes acceptance of any changes.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions.

SMS Communications

By providing your phone number and checking the SMS consent box during booking, you expressly consent to receive text messages from Wild Ranch Cart Rentals at the number provided. You confirm that you are the owner or authorized user of that mobile device.

Message types include booking confirmations, pickup/return reminders, and rental-related updates. You will receive 2-5 messages per rental. As always, message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

You can cancel the SMS service at any time. Just text "STOP" to 720-807-1921. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Opting out of SMS does not cancel your rental reservation. Consent to receive text messages is not a condition of renting from us.

Carrier Liability Disclaimer

Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your mobile carrier and network availability.

Carriers are not responsible for the content of any messages sent via our SMS program. Wild Ranch Cart Rentals assumes all responsibility for the content and frequency of messages sent to opted-in users.

Data obtained from you in connection with our SMS program will not be shared with or sold to third parties or affiliates for their own marketing purposes.
